Puppy Guarantee

This agreement is between

It is agreed between Seller and Buyer as follows:

1. DESCRIPTION OF DOG

The dog sold pursuant to the terms of this agreement is as follows:

2. SELLER'S REPRESENTATIONS

The following representations and conditions apply to the sale of the aforementioned dog:

1. As of the date of this agreement, the dog is in good health and free of communicable diseases.

2. The Buyer has 72 hours to have dog examined by a veterinarian and to personally inspect the dog. Any claims must be made within this time period and will be verified by Seller's own veterinarian.

3. Buyer is completely satisfied with and waives any and all claims regarding the dog's conformation, and outward appearance (meaning the dog meets the breed standard at this age).

4. Buyer agrees upon purchase of the puppy that the Dog will be registered with the following name:_____________________________________________ .

3. CONSIDERATION

This dog, identified in Section 1, is being sold for the sum of $_____________, to be paid in full on D_____M_____Y____

4. STIPULATIONS

This dog or bitch has been graded to be PET / WORKING quality (Schutzhund, AKC, SAR, Obedience, Police).

1. All puppies will be sold on an AKC Limited registration. Seller agrees to lift the Limited Registration upon proof from the purchaser that the following obligations have been met:
   (1) Adult OFA passing certification.
   (2) SchH1 title or equivalent working title.

2. Bitches shall be bred no more than every other heat cycle or no more than one back to back breeding with a one year rest period before being bred again and ONLY after the age of two years.

3. If PET quality, Buyer agrees that seller will register said dog or bitch on a AKC Non Breeding Contract. This non-breeding registration will be held by Seller until veterinarian verification of spay or neuter is received.

4. Any other arrangements may only be made with the Seller's written consent.

5. If buyer chooses to sell dog/bitch or otherwise place him elsewhere, Seller gets first chance to re-acquire dog/bitch according to terms agreed to by buyer and seller at that time.

5. LIMITATIONS OF CONTRACT

This contract applies to the original puppy only and is non transferable to a second party. No replacement puppy will be given if the male or female has been bred, neutered or spayed. Buyer is responsible for transportation costs to and from Eichenluft German Shepherds on original and replacement puppy.

6. HIP GUARANTEE

X-ray films of the pups hips/elbows, showing proper positioning, and meeting OFA standards, must be submitted to OFA for evaluation at the owners expense, prior to one of age.  If in OFA' s evaluation, the pup shows evidence of Hip/Elbow dysplasia, the buyer can choose from one the following options:

1. Return the pup, and receive a replacement pup from the next available litter, not necessarily of the same breeding
2. Keep the pup, and receive 1/2 off the purchase price of a replacement pup. Breeder requires proof of spay or neuter of the dysplastic pup before honoring guarantee.
3. Keep the pup, and receive 1/2 of the original purchase price back. Breeder required proof of spay or neuter before honoring guarantee.

All shipping costs will be the responsibility of the buyer.

By signing this contract, the buyer acknowledges they have been informed young bones do not properly calcify until 12 months of age. Buyer acknowledges we will guarantee the hips and elbows until 12 months of age, providing  the buyer agrees they will not allow environmental conditions to adversely affect the development of the hip and elbow structure. Buyer will provide a certified nutritionally complete food that will not promote excessive growth or obesity. Buyer will provide regular moderate exercise. The buyer is aware if they allow the dog to engage in activities that would stress the hips before the age of 10 months the hip and elbow guarantee becomes null and void. Activities include, but not exclusively, exercise on hard unyielding surfaces, continuous running, repetitive jumping, training in competitive dog sports, or any activity that may cause injury.

7. TESTICLE GUARANTEE

If the male pup does not have both testicles down by the age of 6 months, the buyer can choose from the following options:

1. Return the pup and receive a replacement pup from the next available litter, not necessarily from the same breeding.
2. Keep the pup, and receive 1/3 off the price of a replacement pup of similar value from the next available litter, with proof of neuter.
3. Keep the pup, and receive 1/3 of the price of the original pup back.

8. MAINTENANCE

1. Buyer agrees to maintain this dog in good health, provide routine preventative health care including, but not limited to , inoculation, internal and external parasites, and - where indicated - heartworm preventative medication.

2. Buyer further agrees to provide proper exercise as indicated in order to maintain this dog or bitch in proper weight and physical condition. A proper diet consists of top-quality dog food and supplements.  Vitamin E is an acceptable preservative.

3. Buyer agrees that this dog or bitch is NOT to be LEFT IN A BACKYARD OR KENNEL ONLY. This dog or bitch is sold with the understanding that it was to go to carefully selected parties and that Buyer AVOWED the dog or bitch would become a member of the family. (This is to assure proper development and maintenance of the temperament for which the animal was bred.)

4. Buyer agrees to provide Seller with Photographs suitable for advertising and photocopies of all awards and critiques along with the judge(s) name(s) and the Club sponsoring the show. Buyer also agrees that Seller may use the photographs and any particulars of qualifying awards in any future advertising.

5. Buyer agrees Seller will REPOSSESS DOG OR BITCH UPON EVIDENCE OF NEGLECT AND/OR ABUSE at no expense to the seller.

6. And finally...Buyer agrees that he/she understands this contract fully, and that this contract is under the jurisdiction of the State  of ________________, in the county of _________________. It is agreed the place of venue shall be in ___________ County, _____________________.
